my friend is overstayed an lost a passport since2005.an has an EEA member partner with 1wk baby . he told me he was facing death threats in his country thats why he overstayed. i want 2 know what are his status of applying from here his scared 2go back. anyone who has a hint plz help.

In the US you have to declare refugee status within a very short period of time when you first enter the country.

He is out of status and subject to deportation.
