my friend is living illegally from 6 years in georgia,leaving kid n wife in india.how to get him back legally?they were legally married in arya samaj,according to hindu culture.few days back she came to know that her husband has married a american last september.how to get him back?i have his address n phone number .

your friend should provide all the information she has with her to prove that her husband is a fraud. she need to get the witness sign the affidavit, produce the marriage pricture and wedding card to the U S Embassy in Delhi. beside that she should also give his present address to the U S embassy. since he is in marriage, he can not marry anyone else without divorcing his 1st wife. otherwise his 2nd marriage will get considered as illegal, and he will be considered as a fraud. moreover his marriage will be considered as cheating for greencard (residency card) which normally people will do to get the legality in the US.  by doing this he might get deported from the U S and your friend can get him back.

Indian law will have nothing to do with it unless he is India. Once you  have gone through a few steps you will be able to use that in Indian courts if needed.

First thing is that you contact the US embassy and ICE. That will prevent him from getting residency in the US. If you have documents under international law his new marriage is invalid. If you do not have a marriage certifacte per se you can go to the authorities and get an affidavit. You may need someone else to sign off that a marriage occured as well but it depends on what you have.

They will eventually scoot him out of the US and what happens next depends on you. Phone number, address and even just name will ensure this.

If I understand you well, your friend broke the law since he had been married before he remarried. It depends on what he wants to do, it is not that you can just get him back if he does not want to go back.
