My friend just gave birth to a cute baby boy.?

and my question is, what she supposed to do to stay here in the U.S because she came here 3 times from the past 2 years with her Tourist and bussiness visa. But recently gave birth . And she told me her I-94 was just expired. Is there something good to do with her immigration so she can stay here.

  1. She waits 21 years till the child can sponser her for immigration (if the laws haven't changed by then). Until that time she must return to her country of origin. The baby can remain!


  2. If she isn't meant to be there, then she can't stay in the US. Thats illegal.

    The child isn't an automatic citizen, because she isn't a citizen as far as i know.

    Edit: That doesn't matter, she is there illegally. She either gets a visa, or goes home before shes deported.. If she's deported, they may never allow her back in.

  3. yea technically, since her son was born here, she can stay here. or she can go get her visa again... whats the babys name??? :)

  4. Since she has applied for and was approved for other visas she must be familiar with the process. She has to leave immediately since her visa expired.

    When she gets home she can apply for one of the immigrant visas. All the information can be found on the immigration website.

    The point is the longer she remains out of status in the US the less likely it will be that she can return. ICE used to ignore overstays but that has recently changed.

    Tell her to leave as soon as possible

    To those that continue to believe that a US born child is an automatic citizen or allows the mother to remain you are sadly mistaken. The child can't convey any status to the mother and that doesn't change until the child turns 21.

    A us born baby can obtain citizenship at 18. Read up on immigration law before you give people incorrect information

    That's why so many deported illegals leave their children in America as an anchor.

  6. No, she needs to go home.  An Anchor Baby will do her no good as far as staying in the U. S. of A.

If the baby was born here, it is a US citizen.  The mother, however, is not.  If the father is American, she can marry him and go throught the proper channels to pbtain citizenship.  She should contact immigration and apply.  Other than that, she is now here illegally and she either reapply for a Visa or go home.
