My friend wants to stay with my family and i his parents are ok with it what is the legal way?

he is under age hes is 17 we live in texas and what would we have to do to have him stay at our house legally like if my arents were his guardians?

  1. You don't need to legally do anything. My husband lived with friends before he was 18, and so did his brother. If his parents are okay letting your parents become his official guardian, and able to make official decisions about him, they can just write out a statement.

    Who knows how long it could take to get emancipated. He could almost be 18 by that time anyways. From my experience, you don't need to waste your time and money dealing with the legal system, especially if all parties are willing. Just think of it like when parents get divorced and they're trying to separate their belongings or their children. If they can work something out without having everything spelled out in the divorce decree, the courts don't care. Many parents have joint custody of their children, but never had it officially decided by a judge.

    As long as your parents, and his parents, and he is okay with everything, I wouldn't worry about getting everything written on paper.

    I'm only a little kidding here, it's pretty straightforward. The only catch is that you want something recorded (and preferably notarized) that shows agreement between your parents, his parents, and him. Something might say:

    We, Mike's parents, agree to let our son live with the Jones family. (signature)

    We, the Jones family, agree to let Mike live with us. (signature)

    I, Mike, agree to live with the Jones family. (signature)

    We all agree that this is by arrangement, and can be canceled at any time with 24hrs notice. (all signatures.)

    That way, his parents can't call it kidnapping, and your parents can't make a claim for reimbursement, and mike can't claim to be forced against his will, etc.

    If your parents ever needed proof that they were his guardians, they would have this contract.

  3. Have a lawyer draw up a simple statement of guardianship and get it signed and notarized with his parent's signatures.

    Or if you feel creative you could pretty much do it yourselves and have it notarized. Just a paper that says that the parents (their names) hereby allow (your parents names) to be legal guardians of (his name) until he reaches the age of consent and while he lives at their home (address)

  4. A simple agreement signed by his birth parents and notarized is sufficient.

    The agreement should include that the guardians can make medical and legal decisions regarding the child, ie. authorize medical care, enroll him in school, etc.  

  5. Ummm,, I would have him get a emancipate,, or I would have his parents get a statement,, saying he could stay there!! Well good luck on that!!(=

  6. without giving up total custody the parents would have to have a "Limited power of Attorney" done naming the child and the person assuming resposibility. Specifying what legal resposibilities the parents would have(medical, School, legal etc...) Have the parents see a lawer to work it the agreement. then get it noterized.
