My friend was driving my car & got stopped by police. They took my car because they found drugs. how can i get

how can i get my car if the police found drugs in it. i wasn't there or driving.

  1. Pay the fine and bring proof of ownership. If the police confiscate the car take your "friend" to civil court to get compensation from them.


  2. Well, I am sure that you are upset and this is an extreme example of a simple bad mistake in friendship but I hope you learn from this mistake to not allow others to drive your car. And I think in my state, the car is lost forever unless you pay a lawyer to get it back to you. It might be cheaper to just buy a new car. I hope you never allow others to drive your car again.  

  3. You have to pay to get it out of the inpound lot. None of the circumstances matter; if it's your car, you have to pay.

Just let you know, your ownership of the car can potentially lead to charges against you.  If the drugs were found in the open or in some not too secluded spot (gove compartment, centrer console) where they could have just been stuffed, then there is no reall need for the proscutor to have your car for his case.  He should just take some pictirers of the car and release it.  You can even sue to get your car back - at the very least, you can get the DA t state whether teh car is evidnce or not, and if so, why.

    Don't listen to the guy who said that the car will be sold - forefeiture can only be makde by the owner of the car - you can't forefeit what's not yours.

  6. The police don't have tow trucks, they use a tow service like everyone else. Find out which company towed your car, then phone them. You'll have to go down to their impound lot and pay to get your car back. Do it ASAP because it's probably costing you about $100/day to rent a parking space in their impound lot, plus there will be fees for the actual tow.

    EDIT: You might not have to wait 30 days like that other guy says, the pigs may've just towed it because your friend was unfit to drive. I'd try contacting the tow service first before the coips, because you might not have to show them a bunch of forms and c**p. Plus, they're just citizens, the tow guys, offer the clerk $500. It's cheaper than 30 days of impound!!

  8. You will get it back. It wasn't your friend's property and his deal is not your deal. You are the legal owner, not your friend despite what law he broke! You have to wait 30 days. They car has to be investigated for evidence. They do not have a right to keep it and sell it like the other guy said otherwise anyone who ever got their car stolen wouldn't ever get their property back to them because someone breaking the law has stolen the car. What a joke that other poster is. Go down to the police station and ask what you need to do to get it back. Bring a copy of your registration and pink slip and insurance to show them. They will give you some forms to fill out to bring down to the towing agency to get it out. Expect a large fee for 30 days of storage. You will not be allowed to get it back for the first 30 days but you will get it back. That is just the law.
