  1. Your friend was legally drunk, so hopefully he will get the absolute maximum sentence.  A couple of years may seem like a long time for him to be in jail, but at the end of his sentence his victim is still going to be dead.  Aren't you glad it wasn't you in the car with him??  Sorry, I have ZERO sympathy for anyone who chooses to drink and drive.

  2. I think it will be homicide and your friend will get life.  Life sentence varies in different states.

  3. You know, Bryan, no one here gives a flying rat's azz about your friend. We all hope he gets the maximum penalty no matter what, and even that isn't nearly enough. He's going to rot in prison for a while, he will lose his license, he will be up to his azz from both ends in fines, and he's going to be remorseful, but none of that matters. He killed someone due to his stupidity, and nothing can change that. Imagine his parents. All they will be able to think about from now until the day they die is how your friend killed their child.

  4. When the driver of a moving vehicle causes the death of another person, it is considered vehicular manslaughter. Driving under the influence, gross negligence, speeding, and reckless driving are all illegal behaviors that can result in vehicular manslaughter. In the majority of vehicular manslaughter cases, while the driver does not intend to harm the victim, the illegality of his actions can lead to criminal charges.

Depending on the circumstances of the crime, people convicted of vehicular manslaughter may face either a misdemeanor or felony charge. Driving under the influence will usually always result in a felony conviction, especially if death or serious injury was the outcome of the criminal act. When vehicular manslaughter is caused by speeding or negligence, the defendant may only be charged with a misdemeanor offense. Factors such as a prior criminal record and prior or existing parole or probation status can also affect the outcome of a conviction.

Generally misdemeanor convictions result in fines or no more than a year in a county jail. Felony convictions, on the other hand, result in serving time in a state prison felony DUI vehicular manslaughter with gross negligence is found, the court can impose up to 10 years state prison.

In addition to fines and jail time, people convicted of vehicular manslaughter may also be required to pay restitution to the victim’s family, and may face probation, behavior counseling, and loss of driving privileges.

  5. VARIES BY STATE BUT BASICALLY HES SCREWED.

  6. Probably a couple years in jail and lots of community service but most of all the regret of doing something so stupid and killing someone else

  7. Depends on the state, but it will be a LONG suspension from 5 years to life depending on his previous record.  It will be a LARGE fine.  Depending on the state, it could be 2 to 5 years in jail.

If it was in Roumania some years back, it would be a firing squad.  They didn't have repeat offenders.
