My girlfriend got into a car accident and her insurance was only liability and it was in her fathers name and the other driver whom was at fault has no insurance the bills are coming in what should she do?

  1. Perhaps she should talk to daddy? Also, did she call the police when this accident occurred? If the police don't have a record of the accident, she's screwed.

  4. the other driver was at fault then she pays but its after you sue them for money but yet that still dont get you a car or pay your bill s now and if  they didnt have money to buy insurance they dont have the money to pay your bills so your screwed either way

  5. Shes probably going to have to take the driver at fault to small claims court. Hopefully her car repair will not exceed the state's small claim limits.

    But I assume this was her father's car as it was his insurance? He will have to be involved in each step as he is the registered owner of the vehicle and he also is the one that can be held liable so any decision needs to be his.

    Keep in mind that because she was not at fault does not mean a court will find she was not at fault. Make sure she has photos of the vehicled, photos of the location of the accident so she can addequately describe how the accident happened.

    Make sure she files the proper accident forms with the DMV if her father's insurance company did not. Usually the insurance company handles it but if she didn't inform them she'll need to do it herself. She can lose her license if the forms are not filed promptly.

  6. The loss was to her father, the owner of the car.  He can sue the other driver. (Hope there is a police report/court case establishing fault.)  Girlfriend is not out anything (not her car).  She can pay the bills or walk away; it's daddy's problem. Maybe he will pay the car repair bills for her.  You didn't mention any medical costs to her.  if there were any, she can sue the other driver for those.

  7. If she didn't have uninsured motorist coverage her father is going to have to sue the other driver but if they didn't have insurance they probably don't have much money to cover the loss.  So you get a judgment that wont matter much.
