Question:

My girlfriend wants to study in the states with F1 visa but we also want to get married? how should we do this

She's from the Czech Republic and wants to study here, we would like to get married after she's studied a while like about a year or so. What would be our best option? the K1 visa takes 6 months, so is it possible to go about both at the same time or what?

  1. If she's here on an F1 visa there's absolutely no reason whatsoever to get a K visa.  Both are non-immigrant visas.

    If she's here on an F1 you simply get married and file a petition and adjustment of status package for her.  She'll get an IR-1 visa.  She does not need to leave the USA.  She'll be 100% legal the entire time.

    If she's there and you want to petition her as your fiancee, file an I-129F for her and it will take about a year.  She'll get her K-1 visa.  You've got 90 days to get married after she arrives.  After you get married she'll need to file for adjustment of status.


  2. Tell her you want to go live with her in the Czech Republic, and see if she still wants to get married, then go from there.

  3. Yes, it would be better to have her over as a student and process on her status' change instead of waiting for ever away from each other, same way here...good luck!
