and we recently hired a private caregiver. even though the caregiver is not an employee of the hotel, we were told that she has to be finger printed and checked with the DOA and FBI. Is this true even though she is a private employee and not an employee of the residence?

  1. You posted this as a legal question, but I doubt that there is a governing law.  Instead, it is probably just the policy of the hotel that they want a background check of anyone who is going to be living or working in the hotel.  If it is private, they can establish whatever policies they want.

  2. This is a good move even if it wasn't required by the hotel.  It would be a good move on your part to have this done.

  3. I cannot think of any regulation that would require this at a "retirement hotel." That would be the case in a nursing facility, which is regulated, but not at a hotel. Maybe it is the policy of the hotel, and, if so, that should be respected -- their facility, their rules.

In any event, a background check including fingerprints is a great idea for anyone hiring a caregiver for the elderly.
