My husband and I want to get out of our lease early?

We live in Massachusetts. We just found out we are pregnant and would like to move to a 2 bedroom before the baby is born. We are due in early April. This is the same time our lease is up. Is there any way to opt out of the lease early because of the impending birth of the baby?

  1. Your pregnancy has no effect on your lease at all.

    Check the lease for opt-out requirements, you can usually buy your way out of them.


  2. I don't know Massachusetts law, but in most places, pregnancy does not allow you to end a lease early. It's usually something like active military deployment, moving into a skilled nursing facility, or a new need for handicapped features your place doesn't offer.

    The simplest course of action is to contact your landlord and explain that you're going to need more space, since you're expecting a baby. Ask if they would consider ending your lease early, perhaps for a one-time payment to offset their costs of finding a new tenant earlier than they'd planned.

Having a baby is not a reason to break a lease without penalty.  If you talk to your landlord, maybe they'll be nice and let you out without paying rent for the rest of the lease term, but they certainly don't have to.  That is why my husband and I rented a house with one more bedroom than we need right now - in case we get pregnant and are due before our lease is up.

  4. As long as you are willing to pay to break the lease, the landlord will probably work with you.


  5. They probably won't let you opt out of the lease they will probably give you the option to move to a 2 bedroom unit within their apartment community.
