My husband attempted suicide 5 days ago, spent 4 1/2 days in the hosp, now he is baker acted, h?

can he sign himself out after 24 hrs?

  1. My second husband attempted, and ultmately was successful, at suicide in 2000.  He was 40 yrs old.

    I would love to help you, but don't understand your question...please also let us know what state you and he live in...laws vary state-to-state...

  4. um idk the question but if he ever is in the hospital no one can get out for at least 72 hours (3 days)

  5. Your question isn't very clear. The Baker act in part is in place to evaluate someone who has been deemed unable to care for themselves or is a  danger to themselves. if he is found to be mentally ill (which by attempting suicide he is obviously a danger to himself) they can continue to hold him beyond the 72 hours.  

  6. He cannot "sign himself out".  His commitment is a legal one and depending on findings of health professional, he could be re-committed, placed in an institution, etc.

  8. As I understand the Baker Act, he has to wait for the court to say he can be let out.

    For those who don't know, the Baker Act was enacted in Florida so that the courts could make a person who is in repeated mental problem situations go to get mental health help at whichever institution they send them to.

    The Act was specifically designed to prevent someone from getting stuck in an endless cycle of going in and out of institutions and never getting any real help.  I would think that the court is the one who has to let him out; and that they would do so only with the recommendation of the psychiatrist(s) and or psychologist(s) assigned to his case.

    I doubt he could sign himself out after 24 hours.  And not trying to be mean, but if he tried to kill himself then it would probably be better if he stayed and got the help he needed.

    You wouldn't want to lose him if he got a second chance and used it, and wound up succeeding in suicide.  He needs the help, just be there to support him in this.
