Question:

My husband co-signed for two loans for a person in 2003. She defaulted on both. Can I sue her?

After they came after him, the co-signer, he paid around $5000. One was a car that go repossessed because she didn't make the payments. His credit is shot now because of it and we can't get a loan for a house. He claims he tried to track her down to sue her but she moved right after he co-signed for her twice. I believe I have tracked her down via the internet. Can I, the wife, sue her? I don't know if he would be willing to. Or should I let this die considering it could hurt our relationship?

  1. You have no standing.  He would have to sue.  Depending on when he had to pay, it may be too late for him to sue.  It could be past the Statute of Limitations (SOL).  Check your state:  http://www.bcsalliance.com/statute_of_li...

  3. No, you can't sue her...you didn't enter into the contract with her.

    Your hubby CAN sue her, but ONLY if they had a written agreement that SHE would make the payments.  If you can only prove that he co-signed, but not that she agreed to make payments, then hubby will lose if he tries to sue.  

    He made the mistake of co-signing and as far as the law is concerned, he is equally responsble for the debt.  Unless you can prive to a judge that she agreed to make all the payments, you are totally screwed.

  6. yes you can sue her if it  is within the time limit.i would make your husband sue her, unless you can  afford to be without this money. not only that but if you dont who else is she taking advantage of. it takes years to get good credit, i would not let this go.she has ruined a very good thing.but you  yourself could not do it because he cosigned and the contract was between him and her.just keep this experience in mind for the next time you try and help someone out.2003 seems like a long time ago, bu if she was paying til a few years ago, it might still be ok. id all small claims court. and check out the  time line in your area.
