Hello,

my husband filed a taxreturn without me. I didn't file anything cause I don't work and he said he filed a joint taxreturn. well turns out he didn't - he admitted it yesterday cause i needed the papers that when he went to the tax attorney they said i have to be there to file a joint one and he couldn't reach me so he just did it without me. I believe we would pay less taxes if he would have so my question is if we can somehow correct it. also if we are married do we have to file together? i mean is that the law or this is just somethign more beneficial?

  1. to correct this you would need to file and amened Return, Go back to the accountant who did the taxes and have it corrected.

    and No you do not need to file together, you can file married filing separately. the IRS does not like this though and it is the most unfavorable tax status.


  2. If you are married you don't HAVE to file a joint return, but you are allowed to.  If he filed and didn't file a joint return, that original filing can be amended to be joint.

  3. You can fix this by filing an amended tax return, form 1040X.

  4. File a Form 1040-X changing filing status from whatever to joint and adding you as an exemption.
