My husband got a wage garnishment on his check?

My husband got his wages garnished for a credit card that he owes from back in the day. We can not afford this at all, it's 10 percent of his gross income. We are in the process of filing chapter 7 bankruptcy but I know that takes a little while for the paperwork to go through. Is there a way to stop it from happening again to his next check immediately? Or at least getting it decreased? We live in NJ by the way. All advice will be appreciated.

    What amount are we talking? other debt?

    Go see a bankruptcy attorney, several in fact before you do anything.

    Bankruptcy is a 10 year fat negative on your credit report!

  3. No there is no way to stop it until the papers are filed and the Bankruptcy registered.  Even then you may have problems having the garnishment turned off quickly.  Companies tend to what to get paid what they are owed.

  4. If his check is being garnished, that means the lender got a court judgment.  Doubtful that you can stop it.

  5. If this is a "wage levy" you might be able to go to the court and complete some paperwork and see if you qualify for a reduction or stopping it all together.
