My husband got arrested today .And was charged with assault with deadly weapon

and he was charged with assault with a deadly weapon His Hands ?anyone ever been in this situation? and The sheriffs came two months after the altercation? anyone ever had this happen?

    DO NOT SPEAK TO THE POLICE AT ALL. SAY NOTHING.

    MAKE SURE YOUR HUSBAND SAYS NOTHING TO THE POLICE.

    The other party might of accused him of carrying a weapon like a knife. The police will try to get him to incriminate himself or stumble on  hazy fact, thus reducing his credibility....especially if there is a trial. Say nothing, always request a lawyer and answer no questions.Its not obstruction of justice.

    There is no law that says officers cannot lie to you.

    The officers cannot help you, they will only hurt you.

    Remember, he has the right to remain silent, anything he says or does may be held against him.

    Its a right to remain silent and plead the 5th and its not obstruction of justice.

    The officers will only try to use anything he gives them against him, NOT to prove him innocent.

    The 5th amendment is a right.

  2. no but let me say this, the reason it was a deadly wepon was because of the amount of damage he did to the other person, so next time, just use a gun and make sure you kill the mutha **** too!


  3. assault with a deadly weapon is normally with a weapon (knife,hammer,stone in his hand or something what he "was" able to use!in case he really did not use anything,i would check why they try to charge him like this!and dash is right,a cop can lie to you as long he does not promise you anything,so be careful with this (best thing is to do nothing without a legal advice)

In some states, maybe your hands can be considered a deadly weapon, especially if you are trained in any trype of fighting or matial arts.  Although, each state is different as far as the laws go. As far as the time period until the arrest, the police are allowed time to investigate crimes and it is very common for it to take two months to be investigated and reviewed by the prosecutors and then charges being filed.

  5. Two months after the altercation?  Witnesses?  This is absurd! How can they prove anything?  Where is the weapon?  Who saw this happen?  They can't do a thing since so much time has passed..
