My husband got hurt and work, reported it, and got fired 3 days later?

My husband worked nights shift. He fell and hurt his back and leg. He reported it to his boss who told him he would have to file a report in the AM because the HR office was closed. Three days later my husband got fired for "poor performance" and he was never allowed to go to a workman's comp doctor. When he went in to get his last check he asked if he could see the worker's comp doctor. His boss was there and said he remembered my husband reporting the accident. The HR people said they would "call him and tell him when to go to the doctor." What should he do in this case?

  1. Honestly, it sounds like they dont want to pay out of pocket! (jerks) Please make sure you both logg down everything in a notebook, time/date/who you spoke to/what happened and so on. Do this on phone calls, docotor visits ,everything. First if I where him i would call back HR and demand (nicely) that he is needing to see a doctor now. Do you have insurance? If you do, go ahead and see the doc or go to a doctors care or small in/out clinic and get any injuries documented.  They can charge anywhere from 50 to 100+ bucks.They accept insurance as well/workers comp in many cases. If all else fails, lawyers eat this stuff up. Call a lawyer (workers comp one) and tell them what happened. See what they say. Your hubby can always call HR back and be ket them know his lawyer will be contacting them soon. Good luck and please dont let them walk all over you guys!


  2. You probably need to file a claim with the US Equal Employment Opportunity Commission. Not knowing all the details (i.e., potential past issues), I cannot be more specific. But, if there were any missteps regarding your husband's dismissal, you got them by the b***s.

  3. Get a lawyer and do it today. What they did was illegal.  He should have filed a worker's comp claim the same day and seen the worker's comp doctor right away.  What his employer did was wrong and they will pay penalty for it.
