to us so that we can have the child because i'm unable to conceive. He left me for a few months because we got into it but we're back together now. The baby is due in January. What process do we need to go through so I myself can be legal guardian of this child and what papers do I need to get I know i'll probably be a lawyer but I just jeed some information. We are in VA. The birth mother needs to sign her rights away! Then you will have a certain amount of time to wait before things can proceed because she will be allowed time to change her mind.....I would hire a lawyer to make sure that everything is done legally and may you have a wonderful family! u and that person get together and go to the courthouse and ask  for the papers so that u can sign them for being a legal guardian or go with her to an adoption place and schedule an appointment and have her let them know she wants to give the baby over to you at birth and if everything go right then you will have what you need to be a parent good luck

As the father, he can assume physical custody without any paperwork involved (so long as he is named on the birth certificate).  However, for you to become a legal parent/guardian, you will need to go to court and complete a step-parent adoption, during which she will sign over her rights.  

Please consult a lawyer now, to make sure all of the steps are followed precisely to avoid a lot of pain for all parties involved-especially the child.  If the proper protocol is not followed, she could come back at any time and reclaim her child.

A simple trip to a local adoption lawyer with all 3 of you to draw up adoption papers and sign them.. You go to court once after the baby is born and the judge asks a few questions and stamps a paper and you get a birth Cirt mailed to you with you listed as mother. As long as she is wanting to do this there should be no problem...I would decide early on about her visition rights, will the baby know ectt....

Are you sure this is a situation you want to get involved in?  Bringing a baby into a not-so-stable relationship is NOT the smart thing to do.  He cheated once, he will do it again.

Please don't get a baby involved in this situation.

Wow there are quite a few of thick people here....She was very clear in not wanting your opinions..Freedom is correct and yet she has what 3 or 4 thumbs down..I know I adopted my wife's daughter when we got married and we went through pretty much the same procedure you are asking about....
