It all depends on the criteria of the apartment management.  Surely your husband's foreclosure will appear on his credit file, since it is a matter of public record.  Whether or not it stands in the way of you getting an apartment is the choice of the management.

probably yes or they might ask for more of a security deposit, or less they don't do a credit check.

Maybe you can put the apartment only under your name.

It depends on if they do credit checks for their tenants or not, I am assuming you are renting. With two of you earning income though you should be able to show you can afford the place, he may have to be second to you on the lease though.
