Question:

My husband has a court hearing about child support?

A few weeks ago his attorney was saying bring all the money you have. Now he is saying do not bring anything the hearing is just to set child support your not in contempt. Do not bring a thing.

We have been making the regular payment. But it has been hard. it needs to be reduced based on his pay and how many we have in our home. Anyway what should we do bring the money or not? he is now saying let me handle things....

Just listen to your lawyer, thats what your paying him or her for, as far as having it reduced, you and your hubby will have to go file a modification petition, my bf is going through the same thing, but it seems they never listen to the husband, they are all deemed deadbeats as far as the courts are concerned, even thought there are some p**s poor mothers out there, like my bf's ex who uses the kids for just a meal ticket so she don't have to get off he lazy @ss.It can take such a long time though with the paperwork, we live here in NY and at one point the courts claimed that my BF hadn't even filed a petition for modification, when in fact we had proof that he did, they made him fill out another one, that's just their way of Stalling tactics.

    If you guys can't handle the allotted obligations for support, I would suggest just send what you can afford, they tried the " Your going to jail" scare tactics with my bf, but I found out by researching and speaking to people, that as long as he pays what he can, they can't throw him in jail because he's making an attempt to pay, besides they don't even have room in jail for dads who can't truly afford to pay, and over the last few years things have changed as far as that's concerned, now if they do incarcerate the father, they only make them do weekend time, they sign in on a Friday night and they let them back out on Sunday night, Know why? because they don;t want to stop the father from working and being gainfully employed.

    The family courts and child support never will acknowledge the father as the good parent,the mom could be the biggest drug addict in the world, but the women always win out in the end, that sad because there are many good dads out there that really can't afford to even keep a roof over their heads and food on the table  and barely surviving themselves ,because of the support obligations being so unreasonably high. Most states base support on gross annual or gross  bi-weekly or gross weekly income, that really stinks though , because I don't know anyone who lives off of their gross income, we live on our net income, I wished they would pay me as far as gross income,then I would not have to work 2 jobs and then they tax you to death anyway..

  2. bring the money, records of your payments, and evidence of your expenses so the judge can see why you're requesting the reduction.
