  1. There is no penalty.  He is a citizen.


  2. Yes, you are only allowed to stay here for 21 days without a Visa, then you can get a 2 month or 3 month Visa until you have been here for 1 year.

    You must have applied for and paid for a permanent Resident card by then, or just take a trip out of country, turn around and come back.

    The cycle will start over.

    If he is here without a Visa, he needs to go to the Immigration office, pay a small fine and do as they tell him to avoid going to jail.

  3. It depends on what you mean. If you mean because he is a US citizen and wants to return there should be no penalty. On the other hand if you mean in the Phillipines will there be a penalty then the question will depend on the condition of any visa granted to him. In the event that he has overstayed without applying for an extension then he is in the country illegally regardless of being married to you.

  4. No penalty if he is a US citizen.  If he only has a green card then he will have to apply for a re-entry permit.  He is still liable to file a US tax return, even if all money is earned outside of the US.
