  1. The American has to show proof of income with 3 tax returns that the household income exceeds the Poverty Guidelines for the number of persons involved (in your case three). The American should reside in the States. If you meet those requirements, then you can start on a Spouse Visa, takes about 2 years. Since you are outside the States, it sounds like it would take about 6 years.

In short, they have controlled legal immigration pretty well and the politicians running for office want to grant amnesty for those illegals that broke the law, no matter what we think.

  2. The first step is to file a Petition for Alien Relative,  Form I-130 for your  spouse (husband or wife) to immigrate to the  United States. You file the petition with the Department of Homeland Security, U.S. Citizenship and Immigrations Services  (USCIS) immigration Field Office in the  United States   that serves the area where you live. For instructions on how to file a petition see  Petitioning Procedures: Bringing a Spouse (Husband of Wife) to Live in the United States

Sometimes a U.S. citizen living abroad can file an immigrant visa petition at an U.S.  embassy or consulate (post). To find out whether you can file a petition at a specific post abroad, you must ask that post. For information on how to contact the post, please select U.S.  embassy or consulate abroad (/travel/tips/embassies/embassies_1214.h...

  3. If you are a US citizin, and you are legally married, then he is a legal resident until you divorced or so many years married.

  4. You need to fill out a petition to help a relative become a permanent resident:

Most likely, since you are out of the country, you will need to go through your local US consulate.  You should contact them before you do anything.

This will require filling out an affidavit of support (you need to show that the person you are bringing won't be a homeless bum because you have some money).

Good luck with this, it can seem daunting but you should have too much trouble, especially if you already have a child.
