Question:

My husband is in jail for violating probation for child support . how much time could he get?

he originally was placed on probation for 3 years. he has 6 months left. he owes $1,100.00. should i try to pay that up while he is in there. his weekly is getting paid every week. can they give him the original 3 years or only the remainder of his probation?

He was put on probation.  That is a time that he cannot mess up, or he goes to jail.  Basically, he now has two charges against him and could go to jail for a while.  If you can pay it, pay it!!  You may also need him to go to the court and get the amount of his payment reduced if he is having that much trouble keeping up.  Otherwise, you both need to cut back on expenses.


  2. What you don't say is his sentence. You can be sentenced to, for instance, six months - probated for three years. When you're taken back to court for the violation, you can be sent to jail to served the JAIL time. No credit for time on probation. Of course, by not paying, he not only violated probation but committed the offense again. This is going to keep coming back until it's paid up and kept paid up. So, if you're doing the paying, I guess he's a sort of a rent-a-husband.

  3. maybe u should have thought about that before he went to jail....i think he should be in there until they collect it and not from u anyone who cant pay thier child support should be behind bars!

  4. Most states will keep you until you pay off what you owe, plus any fines or fees associated with the arrest and violation. i would speak to his lawyer, if he has one to find out.

    or you can also ask the courts what would be required. different states have different rules with that.
