My husband is on child support and the child stay with us. What steps do he have to take to get get off? ?

Do we have to go to court if so if so who all will have to be there? HELP husbands been on child support for six months while the child resides with us and we dont receive any income from her what so ever!

  1. You will have to go to court, provide proof that the child is residing with him, and take proof that you've been paying child support.  My best friend has gone through basically the same thing with her hubby's ex...whenever his wages go lower than they were (or higher) at the time she filed for CS, they have to go back and take proof of income and have CS lowered.

    The ex doesn't have to be there, unless she so chooses.  Her attorney mostly handles these situations and advises her of the changes after the fact.  I'd suggest you contacting an attorney and asking these questions.

  2. Go to the place like the child support unit and explain the situation and they believe it or not will tell ya the steps to take. Here you post to go to the courthouse and file a modification to stop the support due to residence change. I know We are in the same boat

    Think the correct form is called

    Petition to Vacate Support;

    Remember the faster you do this the better because it goes back to the date filed

  3. You're going to have to go to court and file for child support from the child's mother.

  5. are you trying to say that you pay your ex hubby child support but the child really lives with you? yes, you are going to have to go to court.
