My husband overstayed his Visa 7 years, we are now married and expecting. How can I get his citizenship?

My husband went to the states from Norway on a 6 month visa. Not sure which kind of visa specifically but figure it was the most basic. He then overstayed his Visa 7 years. We are both in Norway now. We are married since 5/08 in Norway and expecting. We plan to return to the States in 4 years time after I finish school, and want to be sure he can come back with me and work. I am a full US citizen, born n raised & our son will also be a citizen just born in Norway.

Any tips, advice, what steps do we have to take?

  1. I'd go to the embassy where you are

    or get legal advice.

    he has been an illegal  

    and your situation is complicated.

    i cant imagine how or why the USA would help a foreigner who is not even living in the USA. or planning to for several years..but you never know.


  2. You should ensure that you son's birth is registered with the US Embassy/Consulate in Norway.

    You did not mention whether or not your husband was deported for overstaying his visa.

    In any event, you can inquire of the US Embassy/Consulate there to determine his eligibility to re-enter the US as a spouse of a US citizen.  If he is eligible, you will need to apply for an alien relative to enter the US.

  3. Did he get a 10 year ban when you moved to Norway? He could try applying for a residency in the US based on your marriage but I would definitely recommend you getting an immigration lawyer because the application will ask about his prior trips to the US.
