Question:

My husband wants to adopt my daughter?

so that we all have the same last name...her birth father is not in the picture and is not on her birth certificate..what steps do i take..do i have to contact him to give up rights?

  1. I agree that the first thing you need to do is talk to a lawyer in your state.  Just because the birth father's name is not on the BC, does not mean that he has no rights.  

    Also, please keep in mind that, once the adoption is finalized, should you and your husband ever divorce, he will have the exact same rights to custody of your daughter as you.


  2. actually no because you did not put his name down on the birth certificate

    but if you want you can contact him to let him know whats going on and if he is comftorable

    if it goes bad just get a lawyer to settle things out

  3. the first thing you need is a lawyer. and then yes you have to contact the birth father... but maybe ask your lawyer about that before you call the dad.

    i was adopted by my step dad! and i think it was an amazing experience for me and I'm so glad that i have a dad now that loves me! but i wasn't always so thrilled. Just make sure your doing the right thing for your daughter and she'll always thank you later. It sounds like this is best for everyone! But, as "mom" your still the boss of your daughter no matter what!

  4. If her birth father isn't there in her life what's the point in adopting, I think it would be a ggood idea to have your husband adopt your baby, doesn't mean she isn't gonna have him in her life or do this:

  5. you do not need a lawyer...if the birth certificate says father unknown..go online and download (from your state) a copy of an (affadavit of parentage) it tells you exactly what to do.....fill the forms out, get a money order,...and have his name added to the birth certificate. thats what i did.   cost was 40 dollars I believe.

    But also l think the real father have a right to know he have a daughter. maybe he would like to see her . maybe  he have no intensest.

    but my dear think one day u daughter will find out about her real father......... what u will tell her when she ask you??? .

    my advice contact the real father. so u can make no mistake dear. after all  your husband can adopt you daughter.
