  3. Although I am an attorney licensed to practice in California, what follows is not to be construed as legal advice, nor am I undertaking in any manner to represent you in a legal capacity. (Ok...now that the boring disclaimer is out of the way...) The 1st step is to choose the form of business entity.  The simplest is Sole Proprietorship reported on Schedule C of your 1040.  But your husband's business carries great liability potential, so you should realy consider one of the limited liability entities, either a corporation or LLC.  Then if someone sues, for example for a slip and fall accident on one of your husband's floors and they claim it is due to faulty installation, they would be limited to recovering the assets in the business, and could not go after your personal assets such as your house.  If you are in California, an LLC has a tax disadvantage in that there is a gross receipts tax which is not charged to a corporation.  

    Once your business is set up, you also need to look at local regulations, and apply for business licenses etc.  Also, you should look at the small business administration site to see how to go about qualifying for a small business loan for acquiring tools, trucks, etc.
