my husband was in a car accident today, and not at fault. The other driver pulled out in front of him at a 4 way intersection, for which the other driver had a stop sign. Both the streets had a 35 mph limit, my husband slow enough that his airbag didn't deploy. The other guy was driving a truck pulling a trailer with a boat. The police took statements and what seemed cut and dried became mucky. Neither men were cited. How much does the lack of citation against the other driver affect our chance to obtain a settlement for damage, missed work, and car rental from his insurance agency? Or, how hard will it be to have him at least pay our $500 deductable + rental fees

  1. I've been hearing more and more lately about nobody being cited in car accidents. My friend's mother got in an accident, a lady pulled out and hit her when she had the right of way. My fiance's grandfather got sideswiped by a dump truck and his car was spun around and dragged by the dump truck after that, his car was totaled. no one in either situation got cited, the only thing I can tell you is it will be VERY difficult to get their insurance company to pay for the damages, if at all.


  2. Am I understanding correctly that you are concerned that since the other driver wasn't cited you wont be able to sue him for an accident that wasn't  bad enough for your husband's airbag to deploy? Generally when people say settlement they mean sue so I'm just trying to clarify.

    Otherwise if it was determined that the other driver was at fault, his insurance will have to pay for your car to be repaired and the rental.

  3. Find witnesses................get a lawyer...........they will give you good advice.

  4. You are left with a he said, he said situation and the best that you can do is turn everything over to your insurance company and let them try and help you.........

    If you have a witness it would be helpful but the police dont give out citation if they did not see what happened.

  5. Just because the other driver wasn't issued a citation on the spot doesn't mean that one may not be issued at some point during the investigation. You said the police took statements, so they have all of the details & may be investigating this further.

    Even if he does not receive a citation, that does not take away from the fact that he ran a stop sign & hit your husband. Obtain a copy of the final version of the police report for your records & your insurance company will do the rest.
