My husband was in a reck with his sgt and his sgt didnt have insurance the day he rearended my hubby...?

ok so i have a crazy situation, my husband will be a car and his sgt will be b car..

a car was in front of b car and was driving down the road a car had to swerve to the side of the road so he wouldnt hit the car in front of him while he did that b car rearended him because he was following to closely and did some mighty damage to the back of the car, the trunk, right break light and bumpper need to be replaced. at the time a car had insurance but b didnt so what can we do. b told us the insurance he would have had and i called them and they know nothing about him and say he never had a policy with them..i tried to go though my insurance but they say we have to pay the ded. but why should i have to if we had the insurance?? HELP ME PLEASE..oh n yea i can't ask his sgt cuz he is overseas right now and the wife wont even pick up her phone to talk to me about it...SOME HELP ME THANKSSS

  1. You need to get an attorney and sue the Sgt.!  He is responsible and will have to pay!  I would leave his wife a message telling her if she does not pick up and discuss this with you, that you will be forced to start a law suit against them, and then do it!


  2. Thats what your insurance is for. It should, if you have it cover underinsured and no insured drivers otherwise youd be out a car. you can go through your insurance and sue him  later. Or you can just sue him and hope he pays.You didn't meantion how old your car was but the damage might cost more then the car is worth.

  3. Here is the bib thing. Did you get a please report? If you got a police report then you can go to his chain of command. They may be gone but there is going to be a rear detachment . Now because he is deployed you cannot bring any kind of civil suit against him until he returns. It would not hurt to file some papers with the court but nothing will happen untill he returns. Now I would explain the situation to your ins and if you do not have USAA shame on you. Then pay your Ded and get your car fixed. If he is found gealty then he will have to pay. I hope you have a police report. If you do not then it is going to be on you. Lesson learded would be to ake sure the police are there and you get all the drivers info even if they know you.

  5. You have to pay the deductible, any time you put a claim in on your policy.  Then your insurance company chases down the money from the at fault party.

    If you don't want to pay the deductible, fine, withdraw the claim from your insurance company, and sue the sgt directly.  But likely you're not going to see a DIME from him.

    YOUR AGENT should be explaining this to you.

    **it doesn't matter if it's on post or off post.  If they are both privately owned vehicles, file the claim under your policy.**

  6. document document document.  make certain you have all the facts straight.  Then go to your insurance company you will have to pay your collision deductible.  But as soon as they collect money from the other party, they will reimburse you for your out of pocket.  This claim as long as the fault is not your husbands should not be chargable or raise your rates.  I would recommend talking to your agent and let them hlep you understand.  This is a very common accident but the having a police report is probably the biggest saving grace.  Even if the police did not come to the scene.  Do a self reporting claim.  Good Luck.

  8. Here's a huge tip.... Go to your legal assistance office on your post or any military post.  Just take your ID card and vehicle and insurance information.  They will get you the answers you need.
