My husbands ex lost full custody and refuses to follow court order, what can we do?

My husbands ex lost full custody in February of this year. She wanted to take the kids out of state and the courts said no. The judge further ordered her to give my husband the children every day she works. Well, she's wanting to move again, to a different state, and wants to leave the kids with her boyfriend when it is court ordered that my husband get them every day she works. She said she doesn't care and she's going to leave them with anyone she wants to, regardless. I haven't been able to get in touch with our attorney, but was hoping someone could give us some insight on what we can do if she continues to do this before our attorney gets back in contact with us. Please only serious answers.

  1. I can never understand why new girlfriends and wives have to jump in and control the situation between exes. It is not your business. Stay out of it and let him handle it before you are seen as a control freak and become an ex too


  2. You need to file a police report, but more likely try to take this back to court to get sole custody with only supervised visitation if you can get it. If your husband is the primary custodian it doesn't matter where she lives as long as she still shows up for her visitation.

  3. CONTACT THE POLICE!! that is the best advice that I know of.  If it is mandated in the court order get the police involved, they may be able to charge her with attempted child abduction, contempt of court, there are lots of things that she can be charged with.  If you don't want her to be held liable (ie. punished) then contact them and ask what you should do there might be things that they can do to ensure compliance that your lawyer might not be able to do.

    Have faith that things will work out, it may take awhile but they will.

  4. I would contact the court that issued the order. They will contact the ex-spouse and give them the order to obey or charge them with contempt. I would not contact a lawyer unless you need to change something about the order, and it doesn't look like you do at this point.

  5. you contact your lawyer, and they will begin the next money consuming set of court dates.
