Question:

My insurance is void because I didn't declare claims history, But I did, Please help!?

I am more than sure that I declared my previous claims history. I have held insurance with them for 18 months. I recently tried to make a claim but it was declined and I was informed that my insurance is now void. Any advise will be greatly welcome as I am having difficulty in getting another insurance. Thank you.

  1. It is simple tesco insurance did it to me last year. Follow the insurance companies apeals procedure when they investigate it they will look at your original online quote form or listen to the recording of your telephone call.

    (they are legally required to keep your original application and recording of phone calls for 10 years)


  2. Check your policy application, this should tell you what you declared. If you feel you have been denied and cancelled wrongly, you can file a complaint against the insurer with the state insurance department, in the state where you live. You should also write a letter to the insurer, return receipt requested, and ask that your claim be re-investigated and re-opened. You can consult with a public adjuster. The adjuster can try to negotiate on your behalf, but you will have to pay him/her. You can also seek legal counsel if the denial is significant enough financially. The trouble with lawyers is that they charge so much, it often costs more to sue than to walk away. Good luck.

  3. some vague advice ; did you at some stage sign a proposal , listing claims history ? worth investigating . ask to see your insurance proposal . If you believe you are right then keep at them . At some stage it may become more economical for them to back dowm . good luck .

  4. Did you sign an application form? If so, ask for a copy - this way you'll be able to see exactly what information you provided on application.

    Did you apply for the policy via telephone? If so, it's likely that the call was recorded. Ask for a copy.

  5. Request a copy of your insurance application. This should state what claims you reported. If there is even one that you failed to mention to them, they're correct in voiding your policy. If you signed the application without making sure they put all the previous claims you told them about on there.....it's still your fault because you didn't check it before you put your signature on it.

    Also, it's going to be extremely difficult to get written with a standard company if you don't get this cleared up. If you're clearly in the right, it would probably be worth taking it as far as you can since this will cost you TONS in the long run from other insurance companies.

  9. As some of the answers above have pointed out claims history is normally a section on the proposal of which you should have a copy.

    You should continue to take up the matter with your insurance company making sure that you back up your complaint with evidence. After 8 weeks (the time allowed for the complaint to be dealt with) or after a final letter, with decision, has been sent to you if you feel that the insurance companies decision is unjust you can contact the finacial ombudsmen (more info can be found http://www.financial-ombudsman.org.uk/)

  10. when your insurance company sent you there documents there would have been a proposal form if on this for your claims are stated then you can complain and get them to pay out on the insurance. if on this form there are no claims it was down to you to check and inform your insurance company of any changes or claims not stated, as this form is the contract with your insurance company. this does not matter if you signed it or not, as these days it is more a statement of fact.

    the duty of disclosure is down to you and the insurance company.
