Not every person at fault for an accident is forced to get tested for a DUI.  Obviously they didnt feel the guy was under the influence.

First of all, I hope your child is okay.  Second, not all drivers on the road today are under the influence (most, but not all).  Could be the off icier did not feel it was necessary.

No matter who's fault it was, in a case like this the insurance company will more than likely offer you settlement for medical and pain/suffering just due to the fact that it's a minor.

Usually the only drivers that are required to have drug/alcohol tests after a motor vehicle accident are commercial vehicle drivers. This is not a state law, but usually a requirement of the commercial trucking company.

The only logical answer to that question, is that the Officer who responded to the accident scener did not feel that the driver that hit your child was under the influence of alcohol or drugs.

i agree with the second answer. problem is, some people don't look drunk or stoned. regardless, a test should always be taken. I hope your son is okay and that if it was this driver's fault, some kind of justice is served.

In my experience the cops will do as they wish -

The guy who hit me was 100% at fault & the cop made me feel like I was crashing their friggin' HS reunion or something - rolling their eyes at me - heck the cop even gave his statement as to how the crash happened (It was God's fault) - before asking either the guilty party or myself for a statement as to what happened.

Cops are human & can fail -
