We have been living in this one bedroom apartment for almost two years now only to find out that the landlady is charging us more than what our neighbors are paying? What course of action should I take? I hope to seek a refund.

  1. There is no law stating that rents are the same in each apartment.   Your rent should only be the same as someone elses if you moved in the same month, signed the same lease, have the same amenities and are on the same floor.

If you ask around you will find that people are paying a variety of amounts.

You are not due any refund and there is no course of action other then moving out.

  2. They may have gotten a special which happens when trying to market your property.

Sorry, no lawsuit or refund due!

You I would guess may have gotten a rent increase.

    Pets?

Maybe you moved in when they only had a few units to rent.

Example: My 2x2s are renting faster then hot cakes.

    Those no specials.

My 1's are a little slow, running a special.

  3. The only course of action you can take is to move when your lease expires. Refund? Are you kidding. Why would she give you a refund? You signed a lease and agreed on the price to rent the apartment. Just because some one is paying more or less for another apartment does'nt give you the right to void your lease and pay a different amount.

  4. So?

There is no law that states she has to charge you the same.

No units are alike, anywhere in the world.  They all have a different location, view, etc.  Even if the layout is exact.

You can try to talk to your LL or move out at the end of the lease term, but otherwise, 100% legal to do so.

The other lady just cut a better deal for herself.
