Question:

My landlord gave me a 30 day notice to move out,without cause.

So,I offered her rent then she wouldn't take it. Now she put a 72 hour notice on my door trying to backdoor me!! Now I dont have the money cuz I put a down payment on my new apartment because I have kids and don't want to be homeless. Is this right? thx in advance

  1. she can "notice" as much as the "landlord" wants.

    which "notice has a court hearing"?

    you can not be evicted without a "court hearing".

    you have a right to be heard and that is in "court"

    those are "notices".

    To enforce a "notice" a court has to put on a court seal that a Judge heard and witnessed both sides and a put on court seal/ruling.

    the landlord can not move you without one.

    Call the police , if the landlord does anything without a "court hearing".

    that includes blocking entry, etc.  There is a "court" that rules.

    when you go to court, you have a right to be heard and will have to obey the "judges/court orders".

    Your local "housing authority" should have an internet site with the rules.

  2. AS previous answers indicated, if it is without cause, then perhaps, not.  First, read your lease, make sure you understand it and then consult with a land-lord tenant specialist. Often you can receive services for free through your city or county.

  3. Are you sure that you didn't give her any cause to evict you. Good renters are not easy to come by so I find that hard to believe.  The main thing right now is to get a place for you children to live and to be safe so I would do what ever you had to do to make that happen

I'm not an attorney but your local housing authority could probably help you out.  It seems to me that a 30 day term WITHOUT CAUSE can't be superceded by a 72 hour notice, regardless of the type of breach.  If you can't find info re: your local housing authority - you might start with your state's Attorney General's office - they could direct you to the right person/agency for assistance.

  5. If she gave you 30 days notice she can not now change her mind and make it 72 hours. She doesn't have to have a reason, as the owner she can take it back whenever she wants to. You did the right thing by using your money for your next apartment. It's important to get your children into a clean and safe place. Just know that she will probably sue for back rent and sorry to say she'll win if you were there past the last day you paid rent for.

  6. Your LL does not need to give any reason on a 30 day notice. She did not take your rent and sent a 3 day notice instead. On a 3 day notice it surely need a reason and obviously it's fail to pay rent. Now the only way is pay her the rent because she demand it. She can refuse if you only pay her partial of the rent. If you don't have the money, see if you can move in to the new apartment early (if the new place is ready to move in). The last option is just let her file to court for eviction. I don't know which state you're in, it may take a month or so to evict a tenant. By then, you can move to your new place but your credit will be ruined.

    It sounds like your LL really want you to move.

  7. If you do not have a written lease, that means you are a month-to-month tenant, and she can require you to leave with a thirty day notice.  It's time for you to start looking for other premises, and FAST.

  8. if your rental is month to month tenancy (no lease) the landlord can give you a 30 day notice for any reason, just like you could. she turned down the rent, you owe nothing. if she gave you 30 days she cannot now give you a 72 hr notice. you have until the end of the 30 days and she can't get you out sooner.
