My landlord has known that two tenets were not on the lease, now he wants to?

I will explain a bit of the story. My landlord hasn't done JACK all for us. he left a pile of c**p on the back deck, never cleaned it. There was trash everywhere from him left in trash cans and bags all his. The door kept opening from the wind, then he charged us for it. and one of the roommates ended up paying it. ONE OF THE TWO THAT WAS NOT ON THE LEASE. he knew that they were not on the lease. Then he wanted to sell the house, he offered all of us 250 bucks. He even said specifically everyone WHO'S LIVING THERE. He pointed that out! he said he would give us that money if he could sell the house in 2 months. So we said cool. Then he couldn't sell the house so two days after we payed rent we got an eviction letter. Well we did the smart thing researched it and found out he couldn't do that. He has to give us eviction the day before, and he must give us 3 MONTHS before we have to leave. Since were on a year lease. Well i brought that up and he got real angry and started telling us we had 3 days to get out and all this c**p. So what ever i ignored him. Then i payed him rent and he told me that anyone who wasn't on the lease has to be out by monday. I know that he's obviously right, but they have no where to go, and THEY PAID RENT as well. All i want to make sure is that they can get there full month out of it, if not at least our money back because we would all have left if i were to know that. Whats up with this and does anyone got any ANY advise. were young, so we know he's just trying to take advantage of us. It's obvious, we even have witness my GF's MOTHER, and my GRANDMOTHER who would testify to EVERYTHING he's done so far. Like i said i'm young, 20, trying to live out on my own. Ontop of that were not even like the bad young people, if anything were the best young people you can rent to. ALSO I NEED TO MENTION THIS IS THE FIRST TIME HE'S EVER RENTED BEFORE!

  1. You do not sound like you care what happens to others.

    He does not have to give you no 90 days, you violated the lease, you moved people into his property without his approval.

    These people have not paid rent, not to HIM.  Anything they paid you is not legally rent.

    But, you are correct, it will take him a month to get your evicting done.

    He had no limits on which day he wanted to evict you, eviction can start any calender day.

    I am not sure what you are screaming about with your grandmother etc.   But, verbal agreements mean nothing, the only thing that has any bearing is what is law and what is written on your lease.    They can witness all they want, it will not mean anything.


  2. In order to legally remove  you from the house or apt, he has to go to court and tell his side of the story. If you are breaking the lease by having people live there that are not on the lease then you are not going to have much to go on. Remember that it is not your fault that those friends have no place to go. The landlord is going to have to file an "unlawful detainer" action in order to have you evicted and depending on your state laws, there are several steps that he must take first.  

  3. Technically, if you are renting out a portion of your apt or house to someone who is not on the lease, then you are doing a sublet.  Unless your lease allows it, doing this is illegal and he has a right to have that person removed.

    Even though he may be wrong it all goes back to legal technicalities.

    May want to consult an attorney for advice.

    I never said I sympathized with the landlord.  It's ashamed your friends have to find a place to stay but that's how it goes.  Even if your landlord knew before and let it slide, he does not want them there now.   It's your word against his and a judge would side with whatever the lease states.   Hope things turn out ok.
