Question:

My landlord hasn't been paying the mortgage, can I be evicted?

Just had a Solicitors letter informing me they are commencing repossession of my rented flat from my Landlord. They have advised me to see a Solicitor, which I will.

I have lived here for 15 years.

Just wondered if anyone here could give me an idea of what could happen. I'm worried sick.

  1. This happened to a friend of mine.  If the house is repossessed then it becomes the property of the repossessors.  You would have no right to be there, as you've signed no contract with them and you're not paying them rent.

    I advise that you do the following:

    - Start looking for another place to live now and move as quick as you can.  You can contact your local authority for help but if you're not too bad off financially it's better to just sort it out yourself

    - Do not pay your landlord another penny in rent.  You have no legal right to withhold payment but it will take your landlord a couple of months to start eviction proceedings, and hopefully you will have found yourself a new place to live in this time.  Besides, it's probably fair to suggest that you won't be getting your bond back so why should you pay any more rent?


  2. Get yourself to the CAB or a solicitor, to get expert help.

  3. I know a lot about real estate in the USA.   I don't know anything about the UK laws.  If you click on the UK flag at the bottom of the page, you will get great answers.  Or does no one participate there. /

  4. Edit from previous message:  Have just looked up information on sitting tennants.  It is very important that you speak to someone like Shelter or the Council's Private Rent Officer tomorrow as you may well be a sitting tennant and there is no way they can evict you.  Look up sitting tennants and see what you come up with.  Without some legal advice behind you, the solicitors will try to get you out but it looks like you are well protected.

  5. I would start looking for other accommodation right away, as once the mortgagor takes possession they usually want their money. They will sell the place as soon as possible to get back what was owing on the mortgage. Properties are usually sold with vacant possession.

  6. If the place is repossessed you will be on the street simple as that. I would look for somewhere else pretty darn quick. Can't believe your landlord what an a**hole.
