My landlord is a jerk?

My landlord stopped by,my 15yr old was there i was not, my landlord wants to evict me, he had my son sign to say that the paper was received. i am furious!! You dont handle buissness with a child. I am waiting for him to return my call. would paper hold up in court if it came down to it?

  1. It depends on what the paper had written on it.  Subpoena service on a minor is illegal, however a notice to vacate can be given to a minor or just posted to your front door.


  2. In CA, the landlord followed the law. It will likely be valid in most other areas as well.

    Substituted service on another person - If the landlord can't find you at home, the landlord should try to serve you personally at work. If the landlord can't find you at home or at work, the landlord can use "substituted service" instead of serving you personally.

    To comply with the rules on substituted service, the person serving the notice must leave the notice with a person of "suitable age and discretion" at your home or work and also mail a copy of the notice to you at home. A person of suitable age and discretion normally would be an adult at your home or workplace, or a TEENAGE member of your household.


  3. Technically your son is a minor, I don't believe that he can sign for anything if the area you're renting is under your name or another adults.

  4. He was wrong in asking your son to sign anything, but that won't erase the eviction. Leave in the time frame of the eviction notice and you won't need to go to court. Then teach your son not to sign anything and explain to him why as a minor it isn't legal.

    Im 15! And papers should NOT be signed by someone like me...
