My landlord is trying to terminate my lease under false pretenses can they do that?

My landlord stated to me and the security guards of the complex I resides in that I cussed her out. I promise did not cuss that women out I said to them "get off my car" this statement was made to them over 38 days ago and on 8/15/2008 I was handed a piece of paper stating my lease was being terminated read section 14. If there is anyone could appoint me in the direction of some legal advise please help.

  1. The proper term is "cursed" not "cussed".

    You need to repost your question writing out section 14 of your lease.

    If you are mid-lease, you do have the option of refusing to move and force the landlord to prove that you violated it in order to terminate it.

    If your original lease has expired and you are now month-to-month, then you have no case, they can ask you to leave with a 30-day notice at any time for any reason and you would be wasting your time and money by going to court.

    It sound to me like you probably said "get the F*** off my car!" and now you are trying to downplay it.  Has your landlord been trying to contact you?

    Are you required to accommodate the security guards?  Is your landlord being fined for your actions?

    I get the feeling you aren't telling the whole story.  Obviously, if you did what the landlord said you did and it's in violation of the lease then, yes, they can evict you.

    If I were you I'd either talk it out or get really apologetic and really compliant really fast!

  5. this not legal advice but personal.  what does section 14 state. you have to read it to see if what you said is in violation.  why not try apologizing to the person you said it to.  call a lawyer in your area and ask the question you put in e-mail.  sometimes lawyers do not charge for first consultation.

    Generally, unless you go along with them, they have to take you to court to get you out mid-lease and you get to tell your side. . . .

    However, management and security are going to be on your case if you stand on your rights

    There's the issue of your security deposit and last month's rent
