My landlord is very unreasanable and refuses to let me sell my lease?

I am 78 years old i have had a business lease for 32 years it has been 3years now that i have been trying to sell my lease so that i can retire.

My landlord is so unreasenable with potential buyers he keeps putting people off from buying the lease.What can i do and have i got any rights.

  1. If you have had a business for 32 years you must surely have had an attorney by now.

    Ask him/her.


  2. Frankly, it depends entirely on the terms of your lease. Some permit you to sell it on, some require you to surrender it back to the landlord. You'd be well advised to consult a solicitor dealing with this sort of thing, and let him/her read the lease and advise you.

  3. If you are in the Uk you have loads of rights. I had a difficult Landlord when I sold my business lease. He has to have specific reasons why he won't let you go. You must see a Solicitor who specialises in commercial property,  a family solicitor is not good enough. What is the term of the lease, maybe you can just wait it out for a couple of years?  The landlord has a responsibility to accept a reasonable sub lessor or to release you from the lease.  The other angle is that you could walk away from the lease and the landlord would then be forced to mitigate his losses and take a reasonable tenant.  You probably need to contact your attorney and apply some pressure.
