Question:

My lease States that it can be renewed by written agreement but does not specify the time frame to enter this?

I signed a yearly lease contract on 8/13/2007 that ends on 8/12/2008. I paid first months rent and last months rent upfront here in Florida. The only clause in the lease about renewal specifically states--the lease can be renewed or extended only by a written agreement signed by both landlord and tenant, but the term of a renewal or extension together with the original lease term may not exceed one year. A new lease is required for each year.--

That being said, was I required to pay rent on July 13th? I thought my last month's rent should be applied for that month. Also, one day my landlord says he will renew if I pay rent for July and the next day he is threatening eviction when i do not think I technically still owe rent as I did pay for last upfront.

There is no time frame specified to renew the lease so can I wait until August 12th the last day of my existing contract? I know I would owe for the new agreement which would include first and last...Just don't want to pay more

  1. If your landlord was threatening eviction, he may not wish to renew anyway.  I would contact him soon and inquire.  If he's not going to agree to a renewal, you may need to start looking for another place.  If he is, you'll be all set.  But at least you'll know.

    Also, gather your canceled checks/receipts for the rent you've paid, so you'll get that last months rent back.
