My mate is at court next week he got his name took by the transport police for being rowdy on a train?

the summons says he willfully interfered with the comfort of others on the train . does anyone know what he might get p.s it happened in the uk and he is 17 and working part-time

  1. I am not sure. I do know that the transport police take this seriously and rightly so. Perhaps you should encourage your friend to behave himself in future,unless they bar him from public transport of course.


  2. As above, but it might not be the court that he should be worried about. With a criminal record, he could lose his job and be unable to get another one.

  3. With a bit of luck he will get an ASBO banning him from all public transport in the UK for a year.

  4. In Scotland the maximum sentence would be 60 days or a fine of £2,500. If his name was simply taken by the Transport Police it will be at worst a fine. However, the incident will be noted and taken into consideration if he comes up again for sentencing having "breached the peace". He should take this as a warning that a heavy night out could land him in serious trouble.

  7. Ive been done for similair (on london transport) although it went from afray to threatening behaviour, got community service. depending on how rowdy he was and if anyone was affected, he should get a discharge or a fine.

  8. he will probably get an official warning. as long as he didnt hurt anybody the court will probably say you better behave yourself from now on. he may get a fine for court costs etc but that should be about it.

  9. If he is 17 then he is classed a youth and should appear in the Youth Court. If he is pleading guilty and it is his 1st offence, the magistrates have only 4 options: absolute discharge, referral order, hospital order, custody. My bet would be on referral order. If it is not his 1st offence, then it would depend on his previous convictions, but probably receive attendance centre order depending on the circumstances of the offence.

    Having said all that, depending on the circumstances, he may be eligible for a reprimand/final warning if he has not had any/much trouble with the police previously. I recommend he takes legal advice. Because of his age, he should be entitled to legal aid to pay solicitor's fees (tell him to quote R v Scunthorpe Magistrates ep Shipley  1998] EWHC Admin 210 to the solicitors to put on the legal aid form.)
