My mom's work wont let her get a lunch break..?

When my mom don't have groceries cause we just ran out and we're going to buy some, my mom takes her lunch to get us lunch and to get herself some lunch or to take a break. Well, my mom's work is saying that she's taking too long on her break when she isn't and she can't get lunch breaks anymore. Is this illegal?

  1. If your mom is working more than 4 hours she legally has to receive a 15 minute break.  If she works more than 5 hours she legally has to receive a 30 minute lunch.  In our state anyway.  When I was a kid I once worked for a guy so cheap, he would make us work 8 and 1/2 hours and called them a 4 hour block and a 4.5 hour block so we only got one 15 minute break.  Most employers aren't looking to bend the rules to work against the employees, but some do.


  2. She should be buying groceries in the evenings anyway. Most supermarkets are open until at least 9 or there are 24 hour places, too. If it takes her longer than her 1/2 hour or hour to get you your lunches, then she needs to have them packed in the morning or give you lunch money.

    Her boss needs to follow the law as far as lunch breaks and maybe they just said she couldn't leave for lunch.

    Either way, I have never heard of going to the school to give you your lunch. She could buy groceries after work.

  3. I am not sure where you live but if she works for more then 5 hours she is legally entitled to a lunch break, that is the law where I live anyway.

  4. Yes, it's illegal.  She has to be given a break for lunch.  The length of the break and the time at which she is given the break is up to her boss.

  5. How sweet you are for being concerned about your mom. But...your mom has a set lunch period...usually 30 minutes to 1 hour and she must fit her lunch into that time period if she is working at least 8 hours she legally gets a lunch break...but if she is only working a few hours a day then her employer does not owe her a lunch break
