My mom got married to a american citizen and im 20 can she petition me?

i'm 20 yrs old as of july 16th 2008 and my mother god married last april am i going to get anything because i'm under 21 yrs of age?

  1. You got yourself a step-father.  That's it.  What else did you have in mind?


  2. No she cannot petition for you.  She has to be a US citizen.  Her husband cannot help you as step fathers have no standing, as far as immigration issues go.

  3. If she has a green card and you are not married, she can petition for you. If your step-father relationship with her husband began before you were 18, he could petition for you.

    According to section 101(b)(1) of the Act, the definition of "child" is an unmarried person under 21 years of age. If you meet that description, she can petition for you.

    If a mother (or father) has a green card, she can petition for her unmarried child, and the child would be considered a 2nd preference immigrant. At this moment, you could be classified as an F2-2 immigrant, but the waiting period for that type is visa is long.
