My mom has been on medicare and is now on medicade, will she have to forfeit her estate after she passes?

  1. Call your state's Medicaid and get the rules.  Try www.medicare.gov and your state's web site.


  2. Your mom is still on Medicare. Medicaid will pick up the cost of whatever Medicare does not pay. Generally, the only time Medicaid will go after the estate is if your mom needs long term care in a nursing home or assisted living facility. Medicare does not cover long term care and it can be very expensive.

  3. Some states MAY decide to claim assets for repayment of medicaid benefits, but unless they have paid out alot and they decide she has alot of assets, they usually do not persue this. If it would cause a hardship on the remaining family, the family can file paperwork to have it reassesed.

  4. Once she passes, she forfeits her estate.  Dead people can't own things.

    And yes, Medicaid will put leins on her assets to recover what they  paid out (it's paid by the taxpayer, ya know!) for her benefits.  Don't want leins?  Then she can sell her assets now, and pay cash as she goes, instead of having welfare health insurance pay for it.
