pregnancy today she went into her job and they took her insuarnce away and she pays for it. so can she sue or do something about it. Because she is 8 months pregnant and they took her insuarnce away. and she still works. By the way Where in Ca, Oakland.

  1. What do you mean she pays for it?  In California all employers have to offer health benefits for their employees...that is the law.   If her health benefits were taken away then she did something that was against the plan she was on and it made her inelligible for benefits so she was dropped from the plan.  Could she not have re enrolled?  One has to enroll in their employer based health plans every year during open enrollment. It could also be that she is working against doctor's orders.  If her doctor told her to stop working and she is still working then she is doing so against doctor's orders and is not ellgible for benefits any longer because she went against insurance companie's policy.  You haven't given enough information concerning the case so there really is no way of determining what rights your mother has or doesn't have.  


  2. If they cancelled th epolicy it will still continue out until the epiration date. Once the expiration date hits Kaiser will send her a renewal notice asking whether she wants to continue to pay out of pocket. Regardless she will be taken care of if anything happens, she just may have to pay for it herself.  

  3. Find out where the "Insurance Board" in your state is and turn in her employer or the insurance company which ever the culprit is.  If she is paying the premiums they have no right to take her insurance away from her.

  4. why did they take the insurance away?  Did they do away with everyone's insurance?  Did the insurance company go under?  If everyone still has insurance and she is working full time hours still, then yes, she needs to do something legally.  Some companies do not offer insurance to part time workers.  So if she is working and has dropped her hours then they can do that.  

  5. well if she pays for it then she has a right to it. She should have been given the option to be taken off the plan and put on her own plan so she could continue to use the insurance. Kaiser is not a work-based only insurance company. I don't know if she could sue, but it would definitely be something to look into.

    What her employer did was illegal.

    What they are trying to do is force

    your mother into quitting.

    Tell her do not allow them to do that

    to her.

    Instead, tell her to contact the

    National Labor Relations Board,

    and/or the Equal Employment Opportunity

    Agency of Oakland, Ca  and tell them

    she needs information on how to file

    suit against her employer for unfair discriminatory labor practices.

    They will be able to best advise her as

    to her options-

    and more than likely it won't cost

    her a penny-

    However, it will wind up costing her employer

    who will probably be only be too happy

    to settle the entire matter out of court.
