My mom is in a nursing home and i need to obtain power of attorney. i need to know how to do this. ?

like where do i get the forms, what do i do with the forms once i locate them? i mean i fill them out and have them notarized, right ? then what

  1. My mother got hers from the hospital when she started chemotherapy.  She filled out the forms, designated an agent (person getting power of attorney), had them notarized and then filed a copy at the hospital.  I believe they have to be filled out while the person is still coherent.  I'm not sure of the process if they are incoherent....but you should be able to find some legal advice in that situation as well.  Start with the nursing home or her doctor and they should be able to direct you to the right place to get the forms.

  3. I'm pretty sure someone should have been appointed power of attorney before she went into the nursing home.  If I were you I would start with contacting the nursing home and asking them.

  4. Contact an attorney. I think a lot will depend on how capibable she is. My husband and I have POA for his mother, per her requests.  If you mother is coherient, then the process should only take a week or so.
