Question:

My mom just a got ticket for no seat belt, but she had it on just under her arm.?

So she is wondering if she goes to court to protest it, what are her chances? Bcuz the ticket it self say no seatbelt, but she did have it on just tucked under her underarm instead of across her chest. She said she never knew you couldnt wear it like that. neither did I.

  1. Well from the way the law is written, the judge would say that say indeed did not have her seat-belt on, so try but you will loose.


  2. A seatbelt under the arm does not provide enough protection, I would not bother to protest this. It is not worth the day off to go to court.

  3. a seatbelt is there for safety. and its the law to have it buckled at all times in the car.

    Your mother was wearing a lap and diagonal seatbelt. She was not wearing the belt as it was designed to be used.

    Imagine, if you will, the trauma of another driver, if your mother had an accident with them and died. She may have lived if the belt was worn correctly.

  6. She was not properly restrained. That is just as bad as not having one on at all. If she got in a collision, she would either go thru the windshield or break all her teeth on the steering wheel.

  10. Yes, always fight if you are right.  Just take a photo of how she does it.

  11. Seatbelts must be worn correctly.  If they are not then they will not protect a person in a sudden stop or accident.  Most states have proper use clauses and if your mother was not wearing her seatbelt correctly, then she should pay the ticket and count it as a lesson learned.

  12. As far as I know, no car manufacturers are selling cars with lap belts in 2008, therefore I don't think she'll be able to get away with it. If the cop saw your mom driving without a shoulder belt, he/she probably figured she wasn't wearing one. It's gonna be hard to contest this one.
