  3. Yes, you should be able to still press charges, but touching inappropriately is not sexual assault ... in most situations.  Usually sexual assault is the forcible oral, anal, or vaginal penetration of a victim by a perpetrators p***s or finger.  

    Touching someone on their breast or over the clothes would probably constitute sexual abuse and although horrible none-the-less, would not be a sexual assault.

    Wikipedia's definition is broad, but is not accurate to every jurisdiction.  Understand that in some states the inappropriate touching of a person would be sexual assault, in others it is not.

    I was basing my answer on Arizona's Criminal Statutes which for Sexual Assault read as follows:

    13-1406. Sexual assault; classification; increased punishment

    A. A person commits sexual assault by intentionally or knowingly engaging in sexual intercourse or oral sexual contact with any person without consent of such person.

    The inappropriate touching of a person, in Arizona is classified as Sexual Abuse and reads as follows:

    13-1404. Sexual abuse; classifications

    A. A person commits sexual abuse by intentionally or knowingly engaging in sexual contact with any person fifteen or more years of age without consent of that person or with any person who is under fifteen years of age if the sexual contact involves only the female breast.

    Clearly some states will vary in what they interpret as Sexual Assault.  However, the touching of a person inappropriately will be treated a lot differently than the forcible rape of another.

  5. Not worth your time. You don't have any proof, so it will be a 'he said, she said' case and the DA won't want to prosecute. The time you've let pass means it will be even more difficult to sell this to a jury.

    I don't doubt something happened, but the law isn't just about truth; it's about proof. What proof could you offer?

  6. Yes, presuming you haven't washed away his DNA where he touched.

    Of course I would hope that you have had a wash in the last year.

    So you can report it, he can be charged, but lack of evidence will mean the case gets dismissed and it will all be a waste of time for everyone involved.

    Should of reported it immediately and follow Police advice, which would be along the lines of preserving the evidence but not washing until you were examined.

  7. As Terry said, it would be hard to prove.  Is it an actual assault?  They would want to know why you waited so long, you would need evidence, not just you claiming that it happened, unless he openly admits to it and pleads guilty, then it would be easy to prosecute.

  8. Yes, but you would charge him with criminal sexual contact. Not sexual assault.

  9. Yes, you will be able to still press charges. The only trouble you might run into is that the physical evidence might not be still there, thus it might be cumbersome and more trouble then anything.
