My mot and tax were a few week out my van got wrote off whilst i wasnt driving is my insurance invalid ?

i rang today they said that there manager needs to speak with me before they pay out due to a no road tax an mot will i get my money ?

  1. If your car had no MOT then it wasn,t fit for the road. Having no current road tax makes the situation worse. At best, you might recieve a token payment from your insurers, though I wouldn,t hold my breath.

    If your vehicle has been written off then they have every right to ask for a police accident report before they do anything. If this is the case you,re in deep trouble as it will emerge that you had no MOT, tax or valid road insurance (due to lack of the first two)

    If you expect less than £1000, you should drop the claim and try and save your no claims bonus. If you end up in court charged with these three offences then you can expect a minimum of a 6 month ban and a heavy fine.

    That along with lawyers fees etc. could prove to be very costly.

    Sometimes its better to just cut and run.


  2. no because it was being driven illegally. insurance companies will find the smallest thing so they don't have to pay out, no mot and tax is pretty big. sorry not to have better news x

  3. The onus is on you to tell the insurance co. if the vehicle is roadworthy or not. Under these cicumstances i suspect they will believe it not to be. ie no MOT or Tax = not roadworthy. So i will be surprised if they pay up

  5. Fraid not. Your vehicle must have an current Mot and current road tax at the time of the accident to make a claim. Insurance companies can now get this info from the police. You are liable also to be charged with driving a vehicle without the full documentation or keeping one on the road.

  8. fraid so,and be Ware that if the police check up on the accident,they can prosecute for the vehicle being used on a public road,while not carrying a valid mot and excise duty.

    even if you were not at the wheel ,if its registered to you,I'm afraid you carry the blame
