My mother has power of attorney, and won't allow me to see my father in the nursing home.?

How do I fight POA? Dad has Alzheimer and signed it.

  1. .    The Attorney General prosecutes "Elder Abuse" and that is what is happening here. She could allow you entry and force the Home to let you in.


  2. I'm sure a jury will side with you if you do go and see him and get in some trouble for it.

  3. If your father has a mental illness and signed a legal document, if it is proved he had this disease at the time of signing, then its worthless. You cannot sign over your rights when you have a mental illness as then you dont know what you are signing. Im not sure I understand how power of attorney could stop you seeing your father, if you are over 18 then you are legal age and should be able to see him.

    You need to talk to your mother or find a solicitor and fight the paperwork.

  4. I don't see how the power of attorney effects who visits him. She can make medical decisions and pay his bills but not keep you away from your father (assuming you aren't a threat to him).
