My mother passed and i got a property tax check in her name can i cash it or deposit it?

she never got around to making a will though. what other less costly proceedures can i take

  1. only if you are the LEGALLY designated person to do so.

    if you sign her name and the bank cashes it and later it is found out that you did it illegally you will be in trouble....not worth it.


  2. either way you have to forge her name and that's illegal.  if you are executor of her will that's different.  your bank should know.

  3. things like this always happen when i worked for a bank.... if she still has an account open u can deposit into it...dont close yet especially if she may still get other checks like soc sec..u difitnitly cant cash it!! its gonna be a hassle non-the-less to get the money though... hopefully she had a benficary (it could be you)

  4. If you are executor or administrator of her estate, there shouldn't be any legal problem or problem convincing the bank to deposit it to her estate.

    If you are trustee of a trust in her name, you shouldn't have any problem depositing the check in the trust's account, although it might belong to the estate rather than to the trust.

    Otherwise, you may need legal assistance in getting the check reissued or convincing the bank to deposit it.
